change daughters last name

My daughter would like to change her last name to her fathers.

If the name change is to the step-father's last name, it will require termination of the natural father's paternity rights or his consent. If the change is to the natural father's last name, it will require an adjudication of paternity. In either case the Bureau of vital statistics will have to also be made a party to the petition.

Depending on the circumstances surrounding her decision, you will either have to terminate the biological father's rights (step father adopts) or determine paternity (get her dad's last name). You'll have to serve Dept. of Vital Stats in either case.
