name change

In my divorce, it does not request my maiden name back, I want to legally change it, can this be done without going through the court system? I found a name change kit online (this site) and I am not sure it is what I need since the divorce decree does not specify I can have my name back...there are no children involved in this marriage and it only lasted less than 1 year.

You can file a petition in Chancery Court to change your name or if the name change was inadvertently omitted in the divorce decree, a Rule 60(a) motion could be filed. Either way, you will find yourself in Chancery Court.

I think you should go back to your divorce attorney and see if he/she will do it for little or no fee. Make your attorney feel guilty for not getting this done in the first place. This is usually the first thing a woman without children wants back.
