changing child's last name

My divorce was final in 1996 after a 4 year wait. I have custody of my son and his biological father (my ex) has no parental rights (he signed them away). My son hasn't seen his biological father since he was 6 months old. I have been remarried for 5 yrs. He wants his last name to be the same as mine, his little brothers and my husband (he calls dad). What do I do to change his last name? What is the cost (estimate)? Thanks.

If he has voluntarily relinquished his rights, you're half way there. Next is to file a petition in Chancery Court requesting the name change. There will be a filing fee and you'll have to enjoin the dept of vital stats, but it's not a major ordeal.

The cost will vary from lawyer to lawyer.
