Child Support
I have 2 children. My son is 5 and my daughter is 4. They are from 2 different women. I am a single father. I am currently paying child support for my son. $578 a month and I pay his medical and dental. His mother decided to take him out of state to Mississippi. There isn't anything through the court for my son. What happened was that she was on welfare and then the DA took over and has been collecting from me ever since. My son's mother stopped the child support at one time since I had my son half of the time. At this time, I went and established paternity for my daughter and a parenting plan through the court. I was paying my daughter's mom $540 a month child support. Once my son's mother found out, she went back to the DA and they began to garnish my wages again for child support. I was no longer able to pay child support for my daughter. I then went to court for my daughter and lowered my daughter's child support. What I would like to do is take my son's mother to court and lower her child support so that I can pay both my daughter and my son's child support. I am not sure how to go about this since my son is living in Mississippi. Please advise.

I'd suggest hiring an attorney in the jurisdiction the mother lives in and file for a modification of support. Request that the guidelines be used to establish the amount.

Must be something from California. You need to consult an attorney wherever the DA is located. Alternatively, go back to the court that established child support for your daughter and request a modification because of a substantial and material change in circumstances.
