does child support follow the child residence?

My ex-husband lives in Mississippi and I live in Arkansas as well as my son for which child support is paid for.. I need to have his child support increased. This has not been done in thirteen years? The original divorce was in Mississippi. We have lived in AR for 3years. Does the child support follow the child in the state where he lives or will I have to travel all the way to Mississippi?

While I agree in theory with my fellow attorneys, I do not agree in the mechanics of the thing. You do not have to go back to MS to have the CS changed. All you need to do is go to the Office of Child Support Enforcement in the county where you live and request that they take action to increase it. They will send the paperwork to their counterparts in MS who will get it changed for you. It is a federal law called UIFSA that allows this process to happen. It should not cost you anything or if any it will be small.

Child support issues will stay in Mississippi unless the parties and the court agree that the issue should be desided by a court where the child lives.

MS would retain jurisdiction unless otherwise decided by the judge in the MS jurisdiction.
