A child can sue directly for back child support after being emancipated. Emancipation occurs when a child turns 21, begins living independently depending on the circumstances, or is emancipated by court decree. If you sue for back due child support that is more than 3 years in arrears, uyou can expect that the 3 year statute of limitations defense will be raised even if you still consider yourself a minor. The basic lesson is that the custodial parent should petition for backdue child support and attorney fees well within the 3-year limitation period.
