children testifying in court
can a child be suponea to testify in court against his biological mother by his step father
ie: step father want to use his step son to testify against his biological mother to gain custoady of two biological chidren that were from the marriage...... also can they serve him papers without his mother present? he is 16. His step father was present but not his biological mom who has full physical/legal custody.

In my opinion, dragging a minor into court to testify is bad business, even if he is 16 tears old and wants to testify. It is wrong and should not be done. If this were my client, I would immediately file a motion to quash the subpoena.
