Legal Question in Family Law in Mississippi

Being in contempt of court in regards to visitation

My husband is taking the mother of his 2 yr old son to court for being in contempt of the visitation order and for expanded visitation. He has a court order allowing him visitation and on Father's Day, he was supposed to get the entire day. He arrived at her home with a police escort and she still refused to let him see his son. The policeman did a report and both parties have a copy. My questions are, what will likely happen to her since deliberately disobeyed the order? Does my husband have a shot at custody of the little boy because of these actions? This is not her first time not letting my husband see his son. This is just the only one we have a police report for. We do have documented proof though of the different occurences. My husband is seeking expanded visitation and contempt. Is he likely to get his visitation expanded since she has withheld the child? Thank you.

Re: Being in contempt of court in regards to visitation

Your husband should share these questions with his attorney who is in the best position to evaluate his case, the opponent, the judge, and your husband's circumstances. The Court generally doesn't change custody to punish anybody. The judge will act based on what he or she thinks is in the child's best interest.
