Legal Question in Family Law in Mississippi
Defamation of character
A friend just went through divorce proceedings. The preliminary papers said I was not to have any contact with their minor child. I was not notified of this until recently. The final papers do not mention my name at all. I had the child in my care and the father came to take the child and told me I was not supposed to be around the child.
He has no basis for this and I need to know what to do about it. I didn't follow up on the preliminary papers because my friend was worried that it would just add more fuel to the fire her ex was already creating and at the time, her getting custody of her son was more important to me than my pride. Well it's all over now and he's still saying these things.

Re: Defamation of character
The father is interfering with the mother's custody of the child, and she is the only one with standing to have him held in contempt of court. On the other hand, you should obtain written arrangements with the mother if she places the child in your custody.
Technically, you can inform the father in writing that he is not to come back on to your property, and if he does, he may be prosecuted for criminal trespass or stalking. You can also obtain a peace bond or possibly an injunction ordering him to maintain distance from you.
