Legal Question in Family Law in Mississippi

determination of paternity

I have been summoned to appear in Mississippi in a suit for child support for a child that I have no reason to believe is mine. I cannot afford to go to Mississippi and cannot afford consultation. I am told DNA testing at this point has to be requested by me and paid for by me, which I cannot afford to do or have any desire to do, unless ordered by the court. Phone contact has not resulted in speaking with the person who can answer how I can avoid having to go to Mississippi. What papers can I file in response to this suit to 1) request that I not have to appear there and 2) make it clear that it must first be proven that I am the father and 3) if DNA is ordered, it must be paid for by the state (who is filing the suit)?

You need a Mississippi attorney.

I highly recommend filing "an answer" denying paternity and asking for testing.

If you do nothing, you will probably be found to be the father and will be ordered to pay retoactive and current child support.

Check around on testing. It is usually a mouth swab these days. Costs range from over $350 - $850.
