Legal Question in Family Law in Mississippi

Divorce and Bankruptcy

My husband and I are in a Chapter 13 Bankruptcy. We filed two years in December while living in Missouri and have about 2 and 1/2 years to go. My question is,if I file for a divorce, how will the payments be made? Will the court decide how much each of us pay, or will we decide in the papers on our own?

Re: Divorce and Bankruptcy

You will decide in the papers. If you cannot decide, you can submit the issue to the court. If you cannot agree to submit the issue to the court, you cannot get an irreconcilable differences divorce. However, you can get a fault based divorce if there is sufficient evidence of fault and no sufficient defenses.
