Legal Question in Family Law in Mississippi
Divorce Judgement
If it was stated in a divorce
decree that the other party
was responsible for a credit
card, but your name is still
on it and they don't pay. Do I
still have to pay it and does it
effect my credit?

Re: Divorce Judgement
It will affect your credit because the people that issued the card have an underlying contract with you. Therefore, they will most likely not care that the Chancery Court said you were not responsible for the bill. You should pay the card off or make the payments, if you are able. Then I would suggest you hire a local family law attorney and file a Motion for Contempt against your ex spouse. The Judges in Chancery Court have some very convincing ways (usually jail) to make parties comply with the prior orders of the Court. Also, you will almost certainly be awarded attorney fees for having to bring this to the Courts attention.
If you need more information, please email or call my office. Also, I will be In Courtland in about two weeks for court and I would be happy to discuss it with you then.
Re: Divorce Judgement
It will affect your credit. call and cancel it (tell them of the divorce and you want off of it) and pay it off. then sue the ex for the money you paid.
