Legal Question in Family Law in Mississippi

Still trying to get a divorce after four years..

My brother has been trying to get a divorce for four years now, his wife was diagnosed with leukemia a couple of years before. At the time of the seperation and the first court date she was already in remission. The judge would not grant the divorce so that the wife could remain on his insurance at his work and he was also ordered to pay seperate maintance. As I said, that was four years ago and the judge still refuses to grant the divorce even though he has just recently lost his job because of the company shuting down. He now draws his unemployement and has his two boys from his first marriage on medicade. He does not have insurance on himself. He needs to go to the doctor because he could have diabeties but he is unable to pay for the doctor visit. He still has to pay her seperate maintance and try to keep a place to live for him and his boys. The wife is still sending her and her two childrens medical bills to him even though they are on medicade and their father has insurance on them, my brother is still responsible for the bills. They have no children together. What can he do to get this divorce on be able to get on with his life??

Re: Still trying to get a divorce after four years..

He, your brother, is not required by law to support another man's children unless he adopts them. If her children are on their dad's insurance, your brother needs to call all the places he has a bill for and tell them he is not responsible. Apparently the judge does not know they are not his biological children.

As for the divorce, if she would be willing to give him one they can get an irreconcilable differences divorce. If not sue her for one.
