Legal Question in Family Law in Mississippi

No Formal ''Legal'' Custody

I am the father of a 2 year old little boy. When my son was 2 months old, his mother just picked up and moved to New York where she's from. I got her to come back when he was 4 months old and she stayed 3 weeks and left again. I got my son back when he was a year old. 2 months after that his mom returned. She and I were living together for about the first 4-5 months upon her return and then we split, but our son stayed under my care in my custody. Well, she's run off and taken him again for the third time back to New York 16 months later. Each time without my knowing and this time there's another man involved. I want to get my son out of New York and back here with me where his environment is stable. What do I need to do? Do I stand a chance in a custody battle w/her even though we have no formal custody order but he has been under my care full time.

Re: No Formal ''Legal'' Custody

Assuming there has been no divorce, you will need to initiate one requesting custody. I will be happy to discuss this further with you just give me a call.
