Legal Question in Family Law in Mississippi
Grandmom has child Mom wants her back
My mother has guardianship of my 8 year old daughter. I was not proven unfit. She told me it was temporary and that I could have her back any time I wanted her. But every time I try to get her my mother lies to me and makes it more difficult for me to overturn the appointed guardianship. I can't afford legal advice and I make too much money to seek legal aid. How do I go about getting my daughter back on my own?

Legally, you can represent yourself by filing a motion in the guardianship case to terminate the guardianship or in the alternative to have the guardianship returned to you. However, you may only have one opportunity to do this right, and the stakes are too high to represent yourself. Therefore, you need to find a way to raise sufficient money to retain an attorney or find one who will take the case pro bono or at a reduced rate. Contact the Mississippi Bar at 1800-682-6423 for help finding pro bono help.

You can file to have that order dismissed. If you are in a better position now than when that initially took place, I'd say you have a good chance of winning. If money is a concern, try calling around and see if anyone is able to work with you on a payment option.
