Grandparent Interferrence

The father of my child filed temporary custody papers on me, because I moved out of state from Mississippi to Louisiana. Everytime a question comes up his parents objects and calls his lawyer to get what they want. Since the Paper were filed by my sons father, What rights does his parents have in going to his lawyer to get what they want? He lives with his parents and is trying to force me into allowing them to pick him up every weekend. The father stated in the papers he was concerned with his childs safety, but he does not want to pick him up for visitation.

The court can take action to keep your child in the State. However, it cannot use the child as a means to keep you in the State. If your child resides in La. at least six months then La. becomes his home state and any custody issues will have to be heard there. The court also must act in the whatever it believes is your child's best interest.

There is nothing you can do about the grandparents consulting with the father's attorney, and your moving to La. probably creates a circumstance that would require a change in the visitation arrangement. Talk to the grandparents to try and reach an agreement about a visitation schedule.
