Does spouse have to sign guardianship papers naming guardian in case of death of both parents?

It is common for parents to nominate a guardian for their children in their last will and testaments. If they disagree and the court has to consider their different nominations, the litigation will use assets of the children left by the parents for their future care. Therefore, most parents resolve the differences themselves and nominate the same person as guardian, alternate guardian, co-guardian, or alternate co-guardian.
