Am I legally married if there is no record of my marriage? My local circuit court has no record of my marriage license and I have been trying to get a divorce but do I need to?

I would suggest that you go with getting the divorce.

Did you go through a ceremony? If so, get divorced.

Does your spouse deny getting married to you? If so, sue or charge him/her with fraud, assault and abuse.
