Legal Question in Family Law in Mississippi
I was married in Georgia to a lady in 1978, let's say her name and signature on the Marriage Certificate is Jean Doe. But, her birth certificate shows her real name is actually Joan Doe. Are we legally married? If so, who do I divorce, the nonexistent Jean Doe or the actual person Joan Doe? Thank you!!!

You divorce the one on the marriage license but you would be wise to name her in your lawsuit for divorce as "Jean Doe, also known as Joan Doe" and that way you are covered either way. Be sure to let your attorney know of the name discrepancies up front so that no papers have to be "refiled" at a later time to incorporate the name difference.
