Legal Question in Family Law in Mississippi

Can a mother use her ex-husbands name for a child that is not his.

My boyfriends ex-wife had a child recently and even though they have been divorced for 4 years she still gave this child his last name. Is this legal if she knows who the childs father is, an will he be obligated leagally in any way to this child.

no he will not be responsible in any way.

I don't know for sure if it is legal, but I would say no. It would make no sense to allow this to be legal; otherwise everyone would have the last name "Gates".
