Legal Question in Family Law in Mississippi
Parental Rights Of a Father
I wanted to know what I can do if the mother of my son; age 7, refuses to let me see or talk to him over the phone, yet shre still demands her child support. I've already have had to hire an attorney twice. Do the court papers I have mean anything? Who enforces the judgements? Or do I have to keep hiring attorney's every time this happens? Could I call the sheriff's department so I can pick up my son? Thanks for your attention, I'm confused and upset. MC

Consider family counseling if that is possible. Other than that, you have to ask the court to hold the other parent in contempt and to include sanctions such as paying your attorney fees for having to make the motion. If the other parent doesn't relieve herself of contempt of the court's orders, she may be placed in jail, visitation can be changed, and/or custody can be changed.

Child support and visitation are mutually exclusive issues in that you can't stop one just because the other stopped or is messed up.
You need to take her to court to get any satisfaction. You should be asking for contempt and atty fees each time. If it happens alot, you may want to consider filing for a modification of custody.
