Legal Question in Family Law in Mississippi

Paternity

My son is a Tennessee resident his previous girlfriend is claiming her child is his. Though she lives in Tennessee she went to Mississippi to deliver the child. We understand MS law provides her the right to claim him the father without proof of paternity. If this is true how can this be stopped and/or require her to prove paternity. We feel strongly that the child is not his as she would have to have been pregnant the last 10 months.

He should file a petition for paternity and custody in Tennessee. The fact that the child was concieved in Tennessee should give Tennessee jurisdiction. Once he files in Tennessee, he can at the same time request a DNA test, and if the test shows he is not the father, that will decide the issue and she can not pursue the matter again in Mississippi.
