Re: Power of Attorney

All three can be enforceable. As to a person relying on a power of attorney for relief, it depends on whether the person's reliance is justified. This goes for both the person given the power of attorney and the person giving something in reliance on it. To end a power of attorney that does not have an expiration, the principal has to do something inconsistent with the power and the agent has to be know about it. That is why some people who have given power of attorney have published legal notices in newspapers revoking powers of attorney. Also, they may send certified mail letters of revocation to the agent and any person who might rely on the power in the future. The amount of effort depends on a weighing of risk and costs vs benefit.
