Can we purchase optional dental/orthodontic coverage to cover our half of the ex

My husband and his ex are both required to carry medical insurance on their daughter, but not dental or orthodontic. They are to split any cost not covered by insurance for medical and half of all other dental, orthodontic, psychiatric, etc. If we pay the premium on an optional plan that covers dental and orthodontic, and it covers anywhere from 50%-80%, will that count as our half of the expense?

Often, the settlement agreement will state that the parties will equally share any costs not covered by insurance. The question in your case is whether the insurance you are purchasing was contemplated by the parties at the time the property settlement agreement or judgment of divorce was made. I suspect it was not, so the insurance would apply towards your half and more. Your question requires a careful reading of your document. If the document indicates that the insurance was not contemplated, you might want to also obtain a written confirmation from the other parent.
