Legal Question in Family Law in Mississippi

Step parent adoption and bio father child support obligation

My new husband wants to adopt my child and the bio father agrees because he thinks that will wipe out all past and future child support obligations. He has not paid his due part in six years and says he will not pay in the future. Will an adoption relieve him of his past and future obligations or can my child be adopted and the biological father still have to continue to be responsible for his child support?

Re: Step parent adoption and bio father child support obligation

The adoption will eliminate all future responsibility of the father for child support. However, he will still be responsible for all past due child support which has not been barred by the statute of limitations.

Re: Step parent adoption and bio father child support obligation

The adoption will relieve him of any future obligations, from the date of the adoption to eternity. Past due child support cannot be waived and he will still owe that forever, until it's paid.
