Legal Question in Family Law in Mississippi

Temporary Restraining Order

How can my divorced aunt keep her husband from returning to the property that is now legally hers ( granted in the divorce). Does she have an attorney ask for a restraining order or can she file for it herself? Once she has the order and the ex has been notified, if and when, he violates the order can he be arrested for trespassing?

Re: Temporary Restraining Order

She has a right to privacy and can get a TRO herself through the court, but it helps to have an attorney. He can be arrested for trespassing now. If he violates a court order...that's contempt which is a whole different thing.
