Legal Question in Family Law in Mississippi

Visitation rights

My grandson is now 5 years old, he has never known of his biological father. The biological fathers name has never been on the birth certificate, nor has he ever tried to see this child. About 7 months ago, he took my daughter to court for visitation rights. Could you tell me if he is entitled to any rights at all. My daughter has since married and has been married for 3 years now, the man she married has been in my grandsons life since he was 5 months old, and this is the only daddy he has ever known. What are the laws in Mississippi concerning this issue?

Re: Visitation rights

Unless his rights have been terminated or it is proven through DNA testing that he is not the father, he will get visitation. It may be possible to cross file against him to terminate his rights for abandonment, but the court would have to determine that it is in the best interest of the child. The argument would be that it will do more harm and confuse the child to be reintroduced.
