My question is: are there any exceptions to the 12 month prior employment history as related to family leave act??

Family Medical Leave Act-Length of Employment Requirements

The Family Medical Leave Act requires that the person seeking leave have been employed by the employer for at least 12 months AND that the employee have worked for at least 1250 hours during the 12 month period preceding the leave. It is not necessary that the 12 months be consecutive months (in other words, there may be some period during the 12 months that the employee did not work), but the 1,250 hour requirement must be satisfied within the 12 month period prior to the leave. The Act and the regulations do not provide for exceptions to this requirement.
