Can I sue someone for this?

My husband had a verbal contract with his employer to pay for him to continue his education through a craft training program. When he graduated he was suppose to pay my husband $2474.00 for tution he took out of my husbands paycheck. Well now that my husband has quit working for him, he says legally he doesn't have to pay because he no longer works for him. So, does he still have to pay us, or doesn't he? He also recently filled bankruptcy for his company, but we were not filled on his bankruptcy. What can we do to get our money back, or can we? Any information will help, and thank you for your time!

Under the Fair Labor Standards Act, your husband is entitled to at least his minimum wage. If the withholdings caused him to be paid less than minimum wage for his hours of work, you can sue under that Act.

Otherwise, you can sue for breach of contract or for money wrongfully withheld by a fiduciary.
