Legal Question in Immigration Law in Mississippi

Car Accident / No driver license

I have a friend that was involded in a minor car accident was taken to jail . My question is , his wife has applied for his residency and was approved and are in the final stage of completion . The state of Mississippi can Hold him for INS if hes wife pays bond, he has been approve for residency. CAN THEY DEPORT HIM?

Depending on the cause of the accident and who is at fault, this arrest could definitely make him inadmissible to permanent resident status, e.g drunk driving or reckless driving resulting in injury. If his wife is approved for her green card, he still may be able to adjust his status, but would most likely require a waiver of the criminal inadmissibilty ground under this scenario.
