Yes! So long as one party to the conversation knows it is being recorded and consents to the recording the act of taping the call is legal. Obviously if this person was a party to the conversation being recorded he knew it was being recorded and consented to the tape being made thus there is no illegality in that action. It is the secret taping of someone else's conversations without their knowledge or consent which is illegal.
