Legal Question in Landlord & Tenant Law in Mississippi

Do I have the right to break lease?

I need to know all the reasons that a person can break a lease. The people that live above me pound as they walk all the time. I called the office and they spoke with them, it continued. Went to the office again and they said the next time to call they will come and listen. Did that and what they heard was not near the noise we usually do. How long do we have to put up with it before or if we can break our lease. Please help.

Re: Do I have the right to break lease?

One generally has a right to quietly and peaceably enjoy the property they are leasing. Have you taken steps to record the noise they're making? Have you documented the dates and times when the noise is being made? If not, being doing so and then you may have grounds to break your lease. However, your best bet is going to be trying to get your landlord to move to another unit. Good luck.
