Is non-payment of late fee reason to evict?
In our lease agreement it clearly states that if the rent is paid after the 5th day of the month a $10.00 late fee will be added to the rent each additional day it is late. They have paid the rent, but still owe a $50.00 late fee, and are refusing to pay it. Therefore, I do not consider the rent to be paid in full. Is this grounds for eviction and if so, what do I do to get them out?

A lease violation is always grounds for eviction. If the late fees are specifically enumerated in the lease, give the tenants a seven (7) day written notice to pay the late fee. If they don't pay, file eviction papers with the justice court.
