Legal Question in Landlord & Tenant Law in Mississippi

Can I be sued for the same thing twice.

My former landlord sued me for the last month of unpaid rent. On the day of court, he didnt' show up and the judge said I won. I was served a second time a few weeks later. Can he sue me again even after he didn't show up for court?

Re: Can I be sued for the same thing twice.

The process SHOULD be as follows:

1) File case and have defendant served

2) Defendant shows, Plaintiff doesn't, case dismissed for want of prosecution

3)Plaintiff can move to reinstate the cause of action.

If the Plaintiff has filed a new cause of action rather than trying to reinstate the matter, I would bring that up to the judge at court. (If you don't show up the judge won't know and will grant the judgment).

If the matter was reinstated, you need to show up at court, or a default judgment could be entered.
