Trailer Park Lot Rental
My grandmother lives in a trailer park. She is 85 and in a wheelchair. That part doesn't really matter as this is happening to all of the tenants and I feel for each of them. The owner of the trailer park died and the son turned it over to a rental property management co. All tenants were made to sign a lease. Well, my grandmother recvd a notice last week that her lease had run out back in Sept (this is Feb)and that she (the manager)was charging $50 a month for every month the lease was not renewed. This is only lot rent. My grandmother owns her trailer. She has accepted her lot payments every month and I think in doing that, she is renewing the lease herself. If my grandmother had been notified that the lease had run out, we would have gotten her to the office to renew it. I am getting a copy of the signed lease tomorrow. Do we have rights in this situation? Can this woman do this?

No, she can't do that. When the written lease ran out, the lease then became a month-to-month lease which was completed each month by your grandmother remitting her monies and those monies being accepted by the landlord. They cannot charge fees after the fact. Moreover, because the lease is now a month-to-month lease, in order for the lease to be changed or terminated, each party must provide a 30-day notice. In other words, if the landlord intends to increase the rent, they must provide a 30-day notice of their intent to increase the rent. It appears that the new landlord is trying to do something they are not permitted to do.
