Legal Question in Landlord & Tenant Law in Mississippi

Verbal Agreements

I signed a lease to rent an apartment in March and was told by the apartment manager and the asst. apt. manager that there was a move in special in which you would receive one month's free rent. You had to pay the first month and receive the second month free, that would be this month(April) for me. I received notification on 4/11/03 that my rent was past due and that eviction proceedings would begin on 4/13/03. I spoke to the new apt. mgr who said that I should have been told that the second month was not free, they spread the free month over a twelve month period, reducing the cost of the rent per month. This is not what I was told however. What are my legal recourses in this matter? Do I have to pay rent for the month that I was told on three occasions(when I picked up the apt. application, when I returned it and when I signed my lease.)?

Re: Verbal Agreements

What does the lease say? For what time period was the lease that you signed? Generally, the written agreement between the parties will control. If you're going to be there for a year or more, it seems like it wouldn't matter. I'd need more information in order to answer your question.
