He or she can't. It's called a conflict of interest. Move to disqualify the lawyer.

Mr Wagner's answer is usually correct and is definitely advisable. But you may need an attorney to help you succeed. The facts are important here, like how long ago you last used that firm and if they every represented you in something related to the current action.
