Legal Question in Military Law in Mississippi
Honorable Medical Discharge
My daughter enlisted in National Guard. She has been at basic since 8/1/07. She had a stress fracture about the 4th week. Put on crutches. Since that time she has had 2 additional stress fractures. She has been pulled from any PT which now means she on profile. Her papers stated that she was a positive motivator and had passed all issues until dr pulled her. The did bone scan and test, have discussed a 30 day leave to heal, recycle, and medical discharge. She has not had any negative issues in fact her papers say she has done great. Now shes on profile and basically dead in water. They sent her to medical who said due to injuries she is severely depressed and was put on medication. Her bone doc said her fractures are not healing. Her behaviour dr states she is more depressed daily due to inability to complete. What would the option be if she is given medical discharge. What about recycle? They did state if recycled she would pick up where she was at before injury. She was to graduate 9/11 and was pulled from PT 2 weeks into white phase. So if she is discharged due to medical she isnt entitled to any benefits? She has never had any breaks or fractures before enlistment.
