Can a disability lawyer be fired without causing damage to your appeal?
My mother has been attempting to get Disb. & Soc. Sec. for 2 1/2 years. Last Aug.(2003) we hired a disability lawyer. He, nor his office, has been in touch with us since the day we hired him. We have made all the calls to find out if a court date had been scheduled, always being told ''not yet'' and ''it takes time''. I contacted our congressman and informed him of her situation. He looked into it and she is now has a Nov. court date. We called the lawyer & asked if we needed to send him copies of her medical bills and medication receipts for court. He said he had no knowledge of a court date, plus that it was just an appeal and she probably would not be receiving compensation for any of the med. bills / medicine bills that she has paid for since she 1st filed. This firm has done nothing for her, I was the one who found out about contacting our congressman and I was the one who did that. The congressman was the one who got her a court date set. This lawyer has mom believing that if she fires him that she will have to start all over again and wait another 2 years for court plus loose any back pay. Is this true or can we fire him and hire someone who is more concerned with assisting her? Will we owe him anything?

Absolutely,as the choice of attorneys is always the client's choice.The case does not start over,either.
