Legal Question in Social Security Law in Mississippi

long term disablity benifits

My question is regaurding my past employers disabilty binifits.I was employed when I was found to have colon cancer.I started treatment and went on short term disabilty and after 90 days changed to longterm disabilty. My disabilty started on June 2000.I was receiving disabilty benfits from my employers insurance company.after surgery and healing time,I requested that my doctor give me my medical release,so I could return to work, the doctor faxed my requested release to my enployer on November 18 2001. On December 23 2001 my enployer contacted me by phone and notified me that my posistion had been elimanated. My binfits from their insurance company stopped.I have recently filed for my social security disabilty and was approved,I was told several different things would happen.

I was told the insurance company would be pursue me when I got the lump sum settlement for the payments made to me during that time. The gentleman at the social office told me that the social adminstration would deduct money for those months I received benfits from my enployers insurance company.

Thank You

Sincerly

Whether or not the insurance company has the right to be repaid will be set out in the policy itself. I would not take their word for it. I would get a copy of the policy and have an atty read it. Also, it sounds like you might have a wrongful termination case against your employer.
