Legal Question in Wills and Trusts in Mississippi

my father passed away in october and my brother is over the will but he is in prison. would that make me over his will or could someone else be over it.

Convicted felons are precluded from serving as executor under Mississippi law. So you (or someone else who otherwise qualifies) would need to petition for appointment as executor.
