My father-in law died without a will and all the heirs has quit claimed there in

My father inlaw died in 1997. He did not have a will. The heirs of the property quit claimed the house to my husdand. One heir died in 2001 but his wife and adult children quit claimed there rights and interest in the house to my husband as well. We are living in the house and trying to obtain an equityline to do some repairs. Are we at a point in which we can close on the loan without title problems?

You would be filing suit to administer the estate and to determine the heirs. Your primary concern will be to establish a necessary link in the chain of realty title between the decedent and the heirs. Absent a judgment identifying all the heirs, any potential buyer of the property would be uncertain the sellers will convey all property interests.
