My grandmother passed away leaving four children behind, one of whom was my father who passed away five months later. The other three siblings have been arguing about how to dispose of her home and other assets since her funeral in September 2001. They have thus far left me out of any discussions about the division of assets should the property be sold. I do not know if my grandmother left a will. I am my fathers' only child. Does that give me any claim on this property as his sole heir? How do I protect my rights if I have any?

You probably inherit any claim of your father. Formally, you can contact an attorney and arrange to have your grandmother's estate administered by appointing you as the administratrix. However, if you can afford to wait, write a letter to your aunts and uncles and inform them you have inherited your father's interest in your grandmother's estate, and propose that they agree with you within 30 days to formally open the estate and have letters of administration issue. Also, inform them that if everybody can't agree about who the administrator will be, you will proceed to have yourself appointed, but you will intend to treat everyone fairly and with notice.
