Money missing from trust fund

To whom it may concern,

When my Mother passed away in 1999 my children inherited an educational trust fund for the purpose of funding college educations for the children.

My brother was made the trustee of the account which is administered through a national stock brokerage firm. I receive monthly statements on the account as an ''interested party''. Over the past four years checks have been written out of the account , at first the amounts were small but in the first two months of 2004 checks for over $9000.00 were written out of the account. When I called the stockbroker I was told to contact the trustee. I called the trustee and he told me that the funds were used for ''taxes and reinvested''. I see no reinvestments listed on the statement, the mo ney market shares have remained the same over the past year. Since this conversation I have been unable to contact my brother (trustee) by phone, I get no answer. What can I do to maker sure that the fund is being properly handled? By the way, the trustee is not required to provide a yearly accounting to the courts.

Retain an attorney to contact your brother and if necessary require an accounting or seek prosecution of your brother if he is wrongfully appropriating the funds.
