Legal Question in Wills and Trusts in Mississippi

Can I keep the money from a sale of house/property my mother deeded to me

Several years ago my mother deeded her property and a house to me to avoid probate. Originally she had right of survivorship. When we decided to sell the land and the house, she removed the right of suvivorship to make it more sellable. She was making all the payments but has since stopped and all payments fell to me. Now she wants to sue me for the money from the sell. Does she have a legal right to do this? The land is in escrow and to be able to sell the house I will need that money to make numerous repairs. The house is old and not up to code on anything. What should I do?

There is hope for you, but probably too complicated to resolve with a short answer in this format. Call us at 480.835.1500 for a free, no obligation consultation. You will have to bring all the relevant deeds and documents, letters, memos etc. that relate to this case so they can be reviewed. If the court gets involved it might go with a couple of different alternatives, but is likely to give your mother some interest in the proceeds but reimburse you for payments and expenditures, depending upon the facts. It will also make a difference in my mind who has been living in the home. See us or another attorney. I do not believe you will be able to resolve this on your own.

Best regards,

James D. Jenkins
