Legal Question in Wills and Trusts in Mississippi

One parent deceased and the other alive

I need to now if my sisters and I have any rights concerning our mothers property. My mother died in March without a will. She and my father owned a house with some land on it, some land that belonged to my grandmother. The land was my fathers mother. They got the land an a cash settlement before my mother died. Before my father marries again do we have a right to what would have been my mothers.

Re: One parent deceased and the other alive

You need to see how this land was titled. Go to the Chancery Clerk's office at the county's courthouse (some counties have two courthouses) where the land is located and look at the deed or other instrument that places the title in your parents. If it was owned jointly with right of survivorship, it is all your dads. Otherwise you own a part of your mothers interest.
