Legal Question in Wills and Trusts in Mississippi

What to do about parent's moble home?

My mother passed on January 22, 2004. Our father passed on Febuary 22, 2004. There was no will on either parent. There are 6 children involved, 2 of which are shared by the parents. All debts are paid except the moble home. I am sure he had life insurance on the loan with the finance company, they will not tell us anything until we open the estate. There is no money or real estate involved. We do not want to open up an estate if we can avoid that. Can we change it into the childrens' names( or one of our names) without opening the estate? How can we go about that?

You will need to probate your parent's estates.

If there's no money or assets, I'd get what you want out of the mobile home and then tell the finance company to foreclose on the mobile home. Alternatively, if there's life insurance on the loan, get a copy of the death certificate to the finance company. That will trigger the life insurance payment, if it exists. If the loan is paid and the title to the mobile home is clear, depending on its value, you might then have a reason to probate the estate.
