power of attorney in one state have same power in florida

My mother wants to give me power of attorney. She lives presently in Mississippi and is going to move to our house in Florida. She is selling her house and wants to give me power of attorney. If she has the power of attorney made up in Mississipp will it have the same legal status in Florida? Once she moves will she have to have one made up in Florida? This is in case something should happen to her health and become incapacitated. Thank You.

The instrument you are describing is a Health Care Power of Attorney which is also called a Durable Family Medical Power of Attorney. The terms, laws and language can vary from state to state.

If your mother knows for sure she is moving to Florida, she would be better served by having the instrument drawn up in Florida to make sure it complies with applicable law. It is a fairly common instrument and an experienced attorney should only charge a reasonable fee.
