is a probate necessary
My grandmother is the sole heir to her cousin's estate. She had no debts besides the monthly utility payments. If her is estate is in probate, how long should this take and if someone or company comes forward stating there is a debt to collect will this delay processing the will. My grandmother is trying to put this past her as soon as possible. Any suggestions?

Probate is not a long process in Mississippi. Usually, we can schedule a court date in any Mississippi county within 1-2 weeks after meeting with our clients. Assuming the court admits the Will to probate, we will publish Notice to Creditor's in the local newspaper thereby limiting creditors to a 3 month time period in which to file their claims against the estate or be barred.
There are a number of other requirments, but these are almost always completed within that 3 month time period. Thus, it is not uncommon to open and close an estate in Mississippi in 4 months.
