My grandparents died a year ago in Mississippi, without a will. There are 4 children, one of which is deceased and happens to be my father. I have two brothers so the estate is now divided between 4 with one fourth divided into thirds. Correct? My question is it has now been a year since they died and no one has done anything. How can we force them into action. All want to sell except for one, and he is our delay. Should we force probate and if so, what does this entail? Should we contact a real estate agent and put the land up for sale? Their estate consists of land and a small house. The land is long and narrow, making it almost impossible to split since there is very little road footage. My uncle refuses to discuss it, almost like if he ignores us, we will go away. My brothers and I are tired of the whole situation and want out. What's our answer? Thanks.

Being licensed in Mississippi, I can tell you
that court procedures do exist for bringing
forward the administration of your grandparents
estates with the court. Without having their
estates administered by the court and having
the four children vested with title to their
properties, it is rather doubtful if the land
can be sold.
